According to Lozow, the prosecution can use nearly anything the defendant could possibly do--whether it be talking to an inmate or even simply sneezing at a certain time--against him, so his lawyers have probably warned him to be “inanimate”. Lastly, Lozow explains how he would have gone about talking to the defendant, had he been chosen to be his defense lawyer. He says that talking to the defendant, given his or her mental state, is not always useful in this sort of case. Lawyers, therefore, have to judge their clients’ mental acuity--and, thus, their usefulness to the case--during their first or first few conversations.
