DePuy ASR hip lawsuits continue to move forward in state and federal courts, Bernstein Liebhard LLP reports. The first trial in the nation is scheduled to begin on Monday, January 7, 2013, in Prince George's Maryland Circuit Court. The trial is expected to last three weeks, according to court documents. Thousands of DePuy ASR hip lawsuits are also pending in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio. According to court documents, the first trial in the federal DePuy ASR hip litigation will begin on May 6, 2013, with a second trial set for July 8, 2013. (In re: DePuy Orthopaedics, Inc. DePuy ASR Hip Recall
In August 2010, Johnson & Johnson recalled the DePuy ASR metal hip system, after data revealed the devices had an unacceptably high failure rate. According to the company, some 93,000 units were sold globally before the recall was issued*.
Since the announcement of the DePuy ASR hip recall, the entire class of metal-on-metal hip implants has come under scrutiny. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hip implants, and has directed the manufacturers of these devices to conduct post-market safety studies to help it better understand their safety issues. According to the agency, the metal components of the hip implant may rub together, with the resulting friction causing metal debris to enter the surrounding tissue and bloodstream. Many recipients of metal hip implants end up with dangerous levels of cobalt and chromium in their body. **
Johnson & Johnson and its DePuy Orthopaedics unit are involved in a second multidistrict litigation underway in U.S. District Court, Northern District of Texas, involving a metal-on-metal version of the Pinnacle Hip Replacement System. According to court documents, the first trial in the DePuy Pinnacle litigation is scheduled for September 2014.
