The first DePuy ASR hip lawsuit trial in the nation is now underway in Prince George's Maryland Circuit Court. According to a report from Bloomberg News, the trial involves a case brought by a former dancer who claims the two DePuy ASR hip replacements she received left her unable to live a normal life. According to court filings, the Defendants assert the hip replacements were not defective, even though they announced a DePuy ASR hip recall in August 2010, after the implants were found to have an unacceptably high failure rate.* (Jackson v. DePuy ASR Hip Lawsuits
According to the Bloomberg report, DePuy and Johnson & Johnson are facing more than 10,000 similar claims in courts throughout the country. The majority have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio. Judge David Katz, who is overseeing the federal DePuy ASR hip litigation, has scheduled its first bellwether trial for May 6, 2013, while the second will begin on July 8, 2013. Jury selection in the Maryland trial began on January 7th. The trial is expected to last three weeks. The Plaintiff alleges metal debris shed from the ASR hips causes tissue death around the joint and may increase metal ions in the bloodstream to harmful levels, according to Bloomberg.
A second multidistrict litigation has been established in U.S. District Court, Northern District of Texas, for claims involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System. According to court documents, the first trial in the DePuy Pinnacle litigation is scheduled for September 2014.
