DePuy ASR hip lawsuits are moving forward in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Ohio, Bernstein Liebhard LLP reports. According to an Order issued by the Honorable David A. Katz on December 27, 2012, the next Status Conference in the federal DePuy ASR hip recall litigation is scheduled for Thursday, January 10th at 11:00 a.m. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197).

DePuy ASR Hip Recall
According to a report from Bloomberg News, Johnson & Johnson and its DePuy Orthopaedics unit are facing more than 10,000 lawsuits stemming from the August 2010 DePuy ASR hip recall. At the time, 93,000 ASR hips were recalled worldwide, including 37,000 in the U.S, after data indicated more than 12 percent of them failed within five years. Plaintiffs in DePuy ASR hip lawsuits allege metal debris shed from the hips can cause tissue death and may increase metal ions in the bloodstream to harmful levels.**
According to court documents, Judge Katz has scheduled the first trial in the federal DePuy ASR hip litigation for May 6, 2013, while the second will begin on July 8, 2013. What was to have been the first-ever trial in the nation ended yesterday in Prince George's Maryland Circuit Court, after the Plaintiff withdrew her claim. According to Bloomberg, filings in the case indicate the lawsuit may be refilled in the federal multidistrict litigation. (Jackson v. DePuy Orthopaedics Inc., CAL 10-32147)
A second multidistrict litigation has been established in U.S. District Court, Northern District of Texas, for claims involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System. According to court documents, the first trial in the DePuy Pinnacle litigation is scheduled for September 2014.
