DePuy ASR Hip Lawsuits: First State Trial Scheduled to Begin This Week in California, Bernstein Liebhard LLP Reports

Considering that some 37,000 ASR hips were sold in the U.S. prior to the August 2010 recall, it is not surprising that the number of claims continues to grow.

DePuy ASR hip lawsuits continue to move forward in federal and state courts throughout the country, Bernstein Liebhard LLP reports.    Court records indicate that the first trial involving a DePuy ASR lawsuit is set to begin on January 23rd in state court in Los Angeles, California ** (Kransky v. DePuy, BC456086, Superior Court of the State of California). According to Bloomberg.com, some 10,100 similar claims have been filed against Johnson & Johnson and its DePuy Orthopaedics unit in state and federal courts around the country.*

DePuy ASR Hip Recall
The DePuy ASR hip recall was issued in August 2010, after the devices were found to have an unacceptably high failure rate. According to Bloomberg.com, 93,000 ASR hips were recalled worldwide, including 37,000 in the U.S. Plaintiffs in DePuy ASR hip lawsuits allege debris shed from the metal-on-metal hip implants can cause tissue death and may increase metal ions in the bloodstream to harmful levels. Johnson & Johnson recently reported that its fourth -quarter 2012 net earnings included after-tax special items of $0.8 billion, primarily related to an increase in the litigation accrual and program costs associated with the DePuy ASR hip recall.**

The majority of DePuy ASR hip lawsuits have been filed in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. The first trial in the federal DePuy ASR hip litigation will begin on May 6, 2013, while the second will begin on July 8, 2013. (In re: DePuy Orthopaedics, Inc. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hip implants like the DePuy ASR, amid concerns that metal particles shed by such devices can cause an adverse local tissue reaction in the area surrounding the implant. On January 17th, the FDA issued new recommendations for follow-up of patients with all-metal hips. Among other things, the agency said doctors should consider blood testing for metal ion levels in patients who exhibit symptoms of hip implant failure. The FDA also said it is proposing a new rule requiring manufacturers of metal-on-metal replacement systems to submit premarket approval (PMA) applications. The proposal would make such devices ineligible for 510(k) clearances, which do not require that a device undergo human testing if it can be shown it is substantially equivalent to a product previously approved by the FDA.***
