Court documents unsealed in a DePuy ASR hip lawsuit show that an internal analysis conducted by Johnson & Johnson in 2011 indicated the recalled hip implant is likely to fail in nearly 40% of recipients within just 5 years of implantation, Bernstein Liebhard LLP reports. According to The New York Times, Johnson & Johnson never released that analysis, yet publicly challenged similar findings from the National Joint Registry of England and Wales that same year.*

The analysis was part of a cache of court documents unveiled last week in California Superior Court in Los Angeles. According to The New York Times, the first DePuy ASR hip lawsuit in the nation is expected to begin there on Friday. Last Friday, Judge J. Stephen Czuleger unsealed a number of motions that contained portions of pretrial depositions of DePuy officials and related company documents. The information unsealed last week represents only a fraction of what will become public should the trial begin as scheduled, the Times said. (Kransky v. The DePuy ASR hip recall was announced after data from the National Joint Registry of England and Wales found the hips were failing early in 12-13% of patients within five years. In March 2011, the same registry issued an update, reporting that the implants were failing in one-third of patients who had them the longest. According to The New York Times, Johnson & Johnson’s DePuy Orthopaedics unit publicly challenged those findings, and company officials have long insisted their handling of the ASR was “forthright and appropriate.”

According to the Times, 2,000 DePuy ASR hip lawsuits are pending in a consolidated litigation in California state court. An additional 7,000 claims have been filed in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. The first trial in the federal DePuy ASR hip litigation will begin on May 6, 2013, while the second will begin on July 8, 2013. (In re: DePuy Orthopaedics, Inc.
