Testimony continues in the nation’s first trial involving a DePuy ASR hip lawsuit, Bernstein Liebhard LLP reports. According to Bloomberg.com, a biomedical engineer called to the stand yesterday told the Los Angeles Superior Court jury that the ASR hip suffered from numerous design flaws, including the half-circle shape of the metal cup and the cup’s thin wall, that caused it to fail at rates much higher than other implants. The witness, a professor from McGill University, stated that it was his opinion that any claimed benefits of the ASR were outweighed by its risks. * (Kransky v. According to Bloomberg.com, some 93,000 ASR hips were recalled in August 2010, after the metal-on-metal hip implants were found to be failing in 12-13% of recipients within just 5 years. During yesterday’s proceeding, jurors also viewed the videotaped deposition of a DePuy Orthopaedics engineer who stated the company reviewed data showing that 28% of ASR hips had failed at a hospital in Finland. He also discussed findings from the U.K. national joint registry in 2011 showing that more than 27% of ASR hips failed after seven years. Documents disclosed on the eve of the trial included a Johnson & Johnson analysis from 2011 that estimated nearly 40% of the ASR hip implants will fail within five years of surgery.

Johnson & Johnson and its DePuy Orthopaedics unit have been named in more than 10,000 DePuy ASR hip lawsuits since the recall. More than 7,400 have been filed in a federal multidistrict litigation underway in the U.S. District Court, Northern District of Ohio. According to court documents, the first trials in the federal DePuy ASR litigation are scheduled to begin in May. A second DePuy ASR hip lawsuit will go to trial later this month in the Circuit Court of Cook County, Illinois.
