The federal multidistrict litigation established for product liability claims filed in the wake of the 2010 DePuy ASR hip recall (http://www.depuy-asr-hip-recall.com/) continues to prepare for its first bellwether trial, Bernstein Liebhard LLP reports. According to court documents recently filed in the U.S. District Court, Northern District of Ohio, the Plaintiff in the bellwether case has identified 95 potential witnesses that could be called to testify on her behalf. The trial is scheduled to begin on September 9, 2013. (McCracken v. DePuy Orthopaedics Inc., et al., No. 1:11-dp-20485)

DePuy ASR Recall
Court documents indicate that more than 7,800 DePuy ASR lawsuits are now pending in the litigation underway in Ohio, all of which were filed in the wake of the August 2010 recall for the DePuy ASR XL Acetabular hip system. According to the U.S. Food & Drug Administration, the recall was announced after data from a United Kingdom hip registry indicated that the metal-on-metal hip implant’s revision rates within 5 years were approximately 13 percent.
Elsewhere, two DePuy ASR lawsuits have already gone to trial in state court. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County) Additional bellwether trials are also expected to get underway this fall in other state litigations, including one that is to begin on October 1st in California Superior Court.
