As DePuy ASR lawsuits (http://www.depuy-asr-hip-recall.com/) continue to mount in courts around the country, Bernstein Liebhard LLP notes that the first federal DePuy ASR recall trial has been postponed for up to 90 days. According to an Order issued on September 20th, the additional time was ordered to accommodate the scheduling of expert witnesses, as well as additional depositions and pretrial discovery. DePuy ASR Lawsuits
According to court documents, the DePuy ASR lawsuit scheduled for trial is one of more than 8,200 now pending in the Northern District of Ohio. The case was filed on behalf of a Rochester, New York, woman who received the metal-on-metal ASR hip in August 2009, only to have it removed due to complications less than two years later. Last month, her attorneys identified 95 potential witnesses that could be called to testify on her behalf.
Court records indicate that more than 11,500 DePuy ASR lawsuits have been filed in courts around the country since the DePuy ASR recall was announced in August 2010. At the state level, two cases have already been heard by juries. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County)
According to the U.S. Food & Drug Administration, the DePuy ASR recall was announced after data from a United Kingdom hip registry indicated that 12-to-13% of recipients had to undergo revision procedures within just five years of their initial hip replacement surgery. Current estimates now indicate the metal-on-metal hip implant could fail in more than 40% of recipients within five years of implantation.*
