DePuy ASR Hip Multidistrict Litigation (“MDL No. 2197”)
Many of Bernstein Liebhard LLP’s clients who have cases pending or are in the process of filing lawsuits in the DePuy ASR hip MDL allege that they experienced hip replacement pain following hip surgery. As a result, many have had to undergo revision hip surgery to have the initial DePuy ASR metal on metal implants removed. The DePuy ASR hip MDL short form complaint used to bring these cases allows plaintiffs to make claims against DePuy and Johnson & Johnson for 23 different causes of action, including: negligence, strict products liability, breach of warranty, fraudulent misrepresentation and violation of state consumer fraud statutes. DePuy Pinnacle Hip Multidistrict Litigation (“MDL No. 2244”)

The plaintiffs filing Pinnacle hip lawsuits against DePuy underwent hip surgery and received a total hip replacement. The allegations included in these complaints are that the Pinnacle Acetabular Cup System, a device used in total hip replacement surgery, was defectively designed and/or manufactured and that defendants failed to provide adequate warnings concerning the potential for Pinnacle hip problems. Individuals who underwent total hip replacement surgery and received a Pinnacle hip implant often experience hip replacement pain akin to that of patients who received the DePuy ASR hip systems after hip arthroplasty.
