It demonstrates that a persuasive case can bring compensation to those whose metal-on-metal hips have allegedly injured them.

A California judge has upheld an $8.3 million verdict against Johnson & Johnson and its subsidiary DePuy Orthopaedics over its ASR hip implant, which plaintiff Loren Kransky asserted caused him to suffer severe side effects, including metal poisoning, according to court documents. The Rottenstein Law Group LLP, an ASR law firm, notes that this could be a good sign for future plaintiffs. Los Angeles County Superior Court Judge J. Stephen Czuleger ruled May 24 that there was sufficient evidence that the DePuy ASR hip replacement system was defectively designed, upholding the March 8 jury verdict for the plaintiff, according to court documents in Kransky v. DePuy (no. BC456086, Los Angeles Superior Court).

“That the verdict was upheld should encourage those looking to file ASR lawsuits,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “It does not mean a guarantee of compensation—nor a guarantee that all plaintiff’s verdicts will be upheld. But it demonstrates that a persuasive case can bring compensation to those whose metal-on-metal hips have allegedly injured them."

There are an additional 11,000 lawsuits pending against DePuy over the ASR hip implant in state and federal courts, according to Bloomberg.* The ASR was recalled in 2010.
