The judge overseeing hundreds of DePuy ASR lawsuit claims in New Jersey Superior Court, Bergen County, has scheduled the proceeding’s first bellwether trial for October 21, 2013. According to an Order issued on May 24th, discovery for the first New Jersey trial involving the recalled metal-on-metal hip implant device will conclude a little over one month prior, on September 13th. DePuy ASR Recall
The DePuy ASR recall was announced in August 2010, due to the high failure rates associated with the metal-on-metal hip replacement devices. Court records now indicate that more than 10,000 DePuy ASR hip lawsuits stemming from the recall are pending in U.S. Courts. The majority of claims have been filed in the federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where Bernstein Liebhard LLP is actively filing lawsuits. Two trials involving DePuy ASR recall claims have already concluded in other states. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the ASR was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County). According to an April 16th report from The New York Times, evidence in both of those trials indicated that Johnson & Johnson and its DePuy Orthopaedics unit knew that the ASR was faulty years before the recall was announced, but did not publicly disclose the information. Other evidence showed that the five-year failure rate associated with the DePuy ASR could be close to 40%.*
