A proposal to settle thousands of DePuy ASR lawsuits (http://www.depuy-asr-hip-recall.com/ ) filed in the wake of the 2010 DePuy ASR hip recall continues to move forward, Bernstein Liebhard LLP reports. This week, an official copy of the DePuy ASR Settlement Agreement was posted on the court-sanctioned website launched in conjunction with last week’s announcement of the accord. Among other things, the document provides complete details on the terms of the settlement, including eligibility and registration requirements.*

DePuy ASR Lawsuit Settlement
According to a report from The New York Times, the DePuy ASR settlement could resolve roughly 8,000 of the 12,000 product liability claims filed against Johnson & Johnson and its DePuy Orthopaedics unit since the recall was announced in August 2010. To take effect, the settlement must be accepted by 94% of eligible plaintiffs.**
The DePuy ASR settlement was announced on November 19, 2013, in U.S. District Court, Northern District of Ohio, where thousands of federally-filed DePuy ASR lawsuits were consolidated for pretrial proceedings. According to court documents, those eligible for compensation under the proposed agreement include ASR recipients who underwent revision of their artificial hip due to injuries related to the DePuy ASR recall no later than August 31, 2013. Plaintiffs who are not eligible will retain their right to pursue a DePuy ASR lawsuit to obtain compensation for their alleged injuries. (In re: DePuy Orthopaedics, Inc. According to the DePuy ASR Settlement Agreement, eligible plaintiffs will be entitled to a base award of $250,000. That award could be reduced, however, depending on certain other factors, including their prior medical history. Other circumstances could entitle plaintiffs to a supplemental award if they, for example, required multiple revision surgeries, or if they experience “certain extraordinary injuries” in the future.*
