Bernstein Liebhard LLP DePuy ASR Hip Recall Client Interviewed By Reuters

A client of the law firm Bernstein Liebhard LLP, who was implanted with two recalled DePuy hip replacements, shared his experience with Reuters News for a report questioning the manner in which Johnson & Johnson handles claims submitted by individuals affected by the August 2010 recall of its DePuy ASR metal on metal hip replacements.

On August 21, 2011, Reuters News reported on Johnson & Johnson’s novel approach to limit its financial liability and mitigate damages in response to last year’s recall of its DePuy ASR metal on metal hip replacements. Specifically, the article addressed the motivation behind Johnson & Johnson’s decision to hire Broadspire Services Inc. to handle claims made by those implanted with the defective DePuy ASR metal on metal hip replacements. Aubie Brennan, one of Bernstein Liebhard LLP’s clients who received two DePuy ASR hip replacements, provided a personal account to Reuters News for the report. The Reuters report noted that following the recall, Brennan was advised that he would have to undergo revision surgery to remove both metal on metal hip replacements. Initially, Brennan turned to Broadspire for reimbursement. However, Broadspire would not agree in advance to cover the cost of his surgery. Rather, Broadspire informed Brennan that his “only option would be to pay for the surgery himself. Then he would have to submit the doctor’s report to Broadspire, whose physicians would review the case and make a decision on whether the procedure had been necessary.” The cost of Brennan’s surgery was $43,467 – he could not afford to pay that amount or take the risk that Broadspire would decline coverage. Brennan’s experience is an example of why many are criticizing DePuy’s actions in the wake of last year’s recall. As noted in the article, “To critics, DePuy’s handling of its hip implant recall is designed to save money by potentially settling claims with patients before they fully understand their legal rights, or the likely cost of their hip-related medical costs in the future.”
