New York, NY (PRWEB) May 30, 2013
Lawsuits stemming from the 2012 DePuy ASR hip replacement recall continue to move forward in a consolidated litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Case Management Order dated May 24th, the Court has modified the discovery schedule for the litigation’s first bellwether trial. The date for the first trial has also been adjourned until October 21, 2013. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)
“Our Firm continues to receive inquiries from individuals who have allegedly suffered serious complications related to the DePuy hip recall. We are pleased to see this litigation proceeding, and look forward to the first trial in October,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices, including clients affected by the DePuy hip replacement recall. The Firm continues to offer free legal evaluations to anyone who suffered serious complications, allegedly due to the recalled DePuy ASR hip implant.
Depuy Hip Recall
Court records indicate that 637 hip replacement recall claims are pending in the New Jersey litigation. Johnson & Johnson’s DePuy Orthopaedics unit announced the ASR hip recall in August 2010, after data from The National Joint Registry of England and Wales showed a failure rate of 12-13 percent within five years of implantation. According to court documents, more than 10,000 lawsuits stemming from the DePuy hip recall are currently pending in courts throughout the U.S. Most of those lawsuits have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where Bernstein Liebhard LLP is actively filing claims. The federal litigation’s first bellwether trials are slated to begin in September. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197)
In March, a Los Angeles Superior Court jury awarded more than $8 million to a plaintiff in the nation’s first trial over the DePuy ASR hip recall. Just last week, the judge overseeing that case rejected Johnson & Johnson’s bid to have the verdict dismissed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County). In April, a jury found for Johnson & Johnson in a second trial that took place in Chicago. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County). According to a report from The New York Times, documents disclosed in the course of both trials indicated that the Defendants knew that the DePuy ASR was defective years before the hip replacement recall was announced, but did not disclose this information to the public or the medical community.*
Individuals who suffered complications related to the 2010 DePuy hip recall may be entitled to compensation for their damages, including medical bills, lost wages, and pain and suffering.
