Newly unsealed court documents have revealed that Johnson & Johnson, maker of the recalled ASR hip implants, predicted a 37 percent failure rate of its metal hip products within 4.6 years, this according to a new Bloomberg report. The estimate was reportedly revealed in documents unsealed Jan. 18 in the lawsuit of Loren Kransky* in state court in Los Angeles.
As pointed out by the U.S. Food and Drug Administration, the ASR was voluntarily recalled on August 24, 2010 by the manufacturer due to the results of a UK joint registry study. Unlike the internal data, the joint registry data only estimated a 13 percent failure.
Los Angeles personal injury lawyer Jeff Nadrich, of Nadrich & Cohen LPP, has commented extensively on the dangers of metal-on-metal hip implants, and points out that the ASR device is especially problematic. According to Nadrich, “Its design is unfortunately shallower than other hip implant devices. The design makes the implant systems prone to problems, including constant hip pain, thigh and groin pain, pain while walking, weight-bearing pain and pain rising from a seated position.”
Furthermore, the FDA urges ASR hip patients to visit their doctor at once if they experience “pain, swelling, numbness, noise (popping, grinding, clicking or squeaking of your hip), and/or a change in ability to walk.”
