DePuy Pinnacle hip replacement lawsuits continue in federal court with new order setting forth deadlines for pretrial matters, Bernstein Liebhard LLP reports.

DePuy Pinnacle hip lawsuits included in the federal consolidated action, In re: DePuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation (“MDL No. 2244”), continue to move forward, Bernstein Liebhard LLP reports. On August 14, 2012, the Honorable James E. Kinkeade issued a Case Management Order setting forth deadlines for pretrial matters so that the first bellwether case will be ready for trial by September 14, 2014.* The federal DePuy Pinnacle hip replacement litigation is currently underway in the U.S. District Court for the Northern District of Texas. According to an August 1, 2012 Master Case List entered by the court, as of July 31, 2012, there were 1,841 cases pending in the Pinnacle hip multidistrict litigation.**

In order to ensure that the first bellwether DePuy Pinnacle hip lawsuit is ready for trial in September 2014, Judge Kinkeade outlined various pretrial matters and issued discovery deadlines for the course of the litigation. According to the Case Management Order:

  •     Plaintiff fact sheets for cases currently pending should be completed by December 17, 2012;
  •     Depositions will begin in January 2013;
  •     Lawyers for plaintiffs and defendants must recommend 4-6 potential bellwether cases by September 2, 2013; and
  •     Expert and fact discovery in the first bellwether trial case must be completed by May 27, 2014.

In addition to the dates highlighted, Judge Kinkeade also issued detailed discovery deadlines regarding deposition protocol, protocol for selection and conducting of bellwether trials, expert designations, and motion practice.

Hip Replacement Litigation Against DePuy Continues
