DePuy Pinnacle hip lawsuits continue to move forward in the multidistrict litigation underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to a Special Masters Report issued by the court on January 16th, the parties have agreed on a protocol for the selection of cases for the DePuy Pinnacle litigation’s first bellwether trials. The report sets forth a process by which attorneys for both plaintiffs and the defense will ultimately recommend four cases for early trial dates. That recommendation is to be presented to the Court by September 3, 2013. According to court documents, the first trials in the Pinnacle litigation are expected to begin in September 2014. Court records indicate that more than 3,000 DePuy Pinnacle lawsuits are pending in the federal litigation in Texas. All of the complaints involve a metal-on-metal version of the DePuy Pinnacle Hip Replacement System that utilizes the metal Ultamet liner. Plaintiffs allege the all-metal device can wear and shed dangerous amounts of metal debris, leading to implant failure, metallosis and other debilitating complications.

The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hip implants. On January 17, 2013, the U.S. Food & Drug Administration (FDA) proposed an order requiring manufacturers of metal-on-metal total hip replacement systems to submit premarket approval (PMA) applications. This would make the devices ineligible for 510(K) clearance, which allowed such implants to come to market with no human testing. The agency has also recommended that doctors consider metal ion testing for all-metal hip replacement patients who are experiencing symptoms of a failing implant, including pain, swelling, loosening of the implant, or change in the ability to walk.**

Victims of alleged metal-on-metal hip implant injuries may file lawsuits against the devices’ manufacturers to seek compensation for their injuries.
