The number of DePuy Pinnacle hip lawsuits pending in the federal multidistrict litigation currently underway in U.S. District Court, Northern District of Texas, exceeds 3,800, Bernstein Liebhard LLP reports. “We continue to hear from all-metal Pinnacle hip recipients who have allegedly suffered early failure of their implant, metallosis and other complications. It’s not at all surprising that claims continue to be filed in this proceeding,” says Bernstein Liebhard LLP, a nationwide law firm representing clients allegedly injured as a result of the metal-on-metal Pinnacle hip system. Firm partner Jeffrey S. Grand serves on the Plaintiffs’ Steering Committee in the federal DePuy Pinnacle litigation.

DePuy Pinnacle Hip Lawsuits
Court records indicate that the first trials in the federal DePuy Pinnacle litigation will begin in September 2014. Plaintiffs allege the metal-on-metal Pinnacle is prone to wear and can shed dangerous amounts of metal debris, leading to implant failure, metallosis and other debilitating complications. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hips like the all-metal Pinnacle, in which the ball and cup are made from a chromium-cobalt alloy. In January, the agency proposed an order that would make these devices ineligible for 510(K) clearance, which allowed such implants to come to market with no human testing. The FDA has also recommended that doctors consider metal ion testing for all-metal hip replacement patients who are experiencing symptoms of a failing implant, including pain, swelling, loosening of the implant, or change in the ability to walk.*

Individuals who experienced metal-on-metal hip problems may file lawsuits against the devices’ manufacturers to seek compensation for their injuries. In addition to the DePuy Pinnacle metal-on-metal hip implant, the lawyers at Bernstein Liebhard LLP are actively filing lawsuits on behalf of people allegedly injured by the DePuy ASR hip implant. The Firm is also representing alleged victims of the Biomet M2a Magnum hip implant, and is investigating claims related to Wright Profemur and Conserve metal hip implants. In addition, Bernstein Liebhard LLP is closely following developments in the June 2012 Smith & Nephew metal liner recall, and is actively filing lawsuits on behalf of individuals affected by the July 2012 Stryker hip recall for Rejuvenate and ABG II modular-neck hip stems.

Bernstein Liebhard LLP is offering free lawsuit consultations to anyone injured as a result of a DePuy Pinnacle hip implant or other metal-on-metal hip replacement device.
