The number of DePuy Pinnacle lawsuit claims pending in a federal litigation underway in Texas Federal Court has now surpassed 4,200, Bernstein Liebhard LLP reports.
According to a Master Case List update issued by the Court on June 3rd, a total of 4,246 lawsuits have been filed in the multi-district litigation by plaintiffs who allege the all-metal version of the DePuy Pinnacle Hip Replacement System, which includes the Ultamet liner, caused them to suffer metallosis and other horribly painful complications. These complications, which indicate early hip failure, allegedly stem from the artificial hip’s potential to wear out and shed metal debris into the bloodstream. The Case List update was posted less than a month after Johnson & Johnson announced its plans to phase out sales of this device, as well as its other metal-on-metal hip implants.* (In re: DePuy Orthopaedics, Inc. DePuy Pinnacle Lawsuits
Despite no announcement of a DePuy Pinnacle recall, Johnson & Johnson’s decision to end sales of its metal-on-metal hip replacements, including the all-metal version of the DePuy Pinnacle hip device, was announced in a report published May 16th by the New York Times. In citing the reasons for this phase-out, the company noted lower sales demands as well as a recent proposal by the U.S. Food and Drug Administration to institute new regulations for approving this class of devices.*
According to the agency’s order proposed in January 2013, all metal-on-metal hips would be ineligible to receive clearance via its 510(k) program, which allows a product to bypass human testing. If new regulations go into effect, safety and efficacy studies will be required of all metal hip manufacturers to continue selling their products. It is noteworthy to add that the Ultamet liner of the DePuy Pinnacle hip replacement was approved by the FDA in 2005 via the 510(k) process.**
DePuy Pinnacle lawsuits that have since been filed over the implant are now moving forward at a rapid rate in the U.S. District Court for the Northern District of Texas. According to an Order issued by the Court on May 15th, DePuy Orthopaedics has been required to produce monitoring reports related to a criminal investigation of its medical device marketing tactics. According to a Motion to Compel filed by plaintiffs in December 2012, physicians were offered “consulting agreements” from DePuy between 2002 and 2006 “to induce surgeons” to use its knee and hip products.
