DePuy Pinnacle lawsuits (http://www.depuypinnacle-lawsuit.com/) involving a metal-on-metal version of the Pinnacle hip replacement system continue to progress in the federal multidistrict litigation underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to court documents, the litigation’s next Conference will be convened on September 10, 2013, at 2:30 p.m. CST. Matters to be discussed at that time include the selection of Pinnacle hip lawsuits for the proceeding’s bellwether trials, and an update from counsel on the status of the litigation. Pinnacle Hip Lawsuits
Court records indicate that more than 4,600 DePuy Pinnacle lawsuits involving a metal-on-metal version of the implant that utilizes the Ultamet liner have been filed in the Northern District of Texas. All of the claims allege that the all-metal Pinnacle can shed dangerous amounts of metal ions into recipients’ tissue and blood stream, leading to painful complications that may necessitate revision surgery to remove and replace the device. Plaintiffs further allege that the metal-on-metal Pinnacle suffers from some of the same types of design flaws that prompted Johnson & Johnson’s DePuy Orthopaedics unit to voluntarily recall its ASR hip implant line in August 2010, and question whether it should have been recalled as well.

The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hip implants. On January 17th, the agency proposed new regulations that would subject such devices to greater regulatory scrutiny, including a rule that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them. The FDA also warned that the metal debris shed from such devices may cause serious complications, including adverse local tissue reactions, premature device failure, and other long-term health consequences.

According to a New York Times report published on May 17th, DePuy Orthopaedics has decided to phase out sales of metal-on-metal hip implants, including the all-metal Pinnacle. In doing so, the company cited slowing sales, as well as the FDA’s recent actions.*
