DePuy Pinnacle hip lawsuit (http://www.depuypinnacle-lawsuit.com/) claims involving a metal-on-metal version of the hip replacement system continue to mount in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to a Master Case List issued by the Court on September 3rd, at least 4,880 DePuy Pinnacle lawsuits have been filed in the proceeding since it was first established in May 2011.
“Our Firm continues to hear from DePuy Pinnacle recipients who have suffered painful complications allegedly associated with the metal-on-metal version of this system. We are not at all surprised to see that nearly 5,000 Pinnacle hip lawsuits have been filed in the federal litigation,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, serves on the Plaintiffs’ Steering Committee for the federal litigation. The Firm continues to offer free legal evaluations to alleged victims of serious complications associated with the all-metal DePuy Pinnacle Hip Replacement System.
DePuy Pinnacle Lawsuits
According to court documents, all of the DePuy Pinnacle lawsuits pending in the Northern District of Texas involve a version of the Pinnacle hip system that utilizes the Ultamet liner. Plaintiffs allege that this design suffers from similar flaws that resulted in DePuy Othropaedics' worldwide recall of its ASR hip replacement line in August 2010. Among other things, Pinnacle hip lawsuit plaintiffs question whether the all-metal Pinnacle should have been recalled as well.
According to a New York Times report published on May 17th, the all-metal Pinnacle hip was one of the devices affected by DePuy Orthopaedics’ recent decision to phase out sales of metal-on-metal hip implants. The company said the decision was prompted by slowing sales, as well as recent actions by the U.S. Food & Drug Administration (FDA) regarding all-metal hips.* On January 17th, the FDA proposed new regulations that would subject such devices to greater regulatory scrutiny, including a rule that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them.
Patients who have suffered painful and debilitating complications allegedly as a result of the all-metal DePuy Pinnacle hip implant may be entitled to compensation for medical bills, lost wages, pain and suffering, and more.
