The federal judge overseeing thousands of DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/ ) now pending in a multidistrict litigation underway in U.S. District Court, Northern District of Texas, has rejected a number of Defense motions pertaining to the proceeding’s first bellwether trial. In three Opinions issued on July 18, 2014, U.S. District Judge Ed Kinkeade refused to exclude testimony by six of the Plaintiffs’ expert witnesses, denied bids to quash deposition of two other experts, and rejected summary judgment motions on five issues. Court records indicate that more than 6,400 Pinnacle hip lawsuits are now pending in the litigation underway in the Northern District of Texas, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. All of the lawsuits claim that the metal-on-metal version of the Pinnacle hip replacement can shed dangerous amounts of toxic metal ions into the surrounding tissue and blood stream. The two cases scheduled for trial on September 1st where filed on behalf of Pinnacle hip recipients from Montana who underwent revision of their hip replacement after allegedly developing pain, metallosis, and elevated blood serum levels of chromium and cobalt.
In January 2012, the U.S. Food & Drug Administration (FDA) warned that metal-on-metal hips like the device at the center of the DePuy Pinnacle litigation were more likely to fail early than those made of other materials. The agency also revealed that it was considering new rules that would subject the all-metal hips to greater regulatory oversight.
In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits.*
