The London High Court has approved a DePuy Pinnacle lawsuit (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) filed on behalf of plaintiffs in Wales who were allegedly injured by a metal-on-metal version of the Pinnacle Hip Replacement System, Bernstein Liebhard LLP reports. According to a report from Wales Online, the Court issued a Group Litigation Order on August 1st, which clears the way for Pinnacle hip recipients to pursue legal action against DePuy International Limited. Among other things, the lawsuit alleges that the hip implant’s all-metal design caused recipients to suffer an adverse tissue reaction that resulted in early failure of the device. “The allegations set forth in this complaint echo those included in DePuy Pinnacle lawsuits filed in U.S. courts on behalf of our own clients. This device was sold in many countries, so we aren’t surprised that the litigation has spread overseas,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to individuals who were allegedly harmed by the metal-on-metal version of the DePuy Pinnacle Hip Replacement System.
DePuy Pinnacle Lawsuits
According to court documents, more than 6,000 claims have been filed in U.S. courts on behalf of individuals who allegedly suffered serious complications due to a metal-on-metal version of the Pinnacle hip that utilized the Ultamet liner. The majority of these cases are pending in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. (In re: DePuy Orthopaedics Inc. Pinnacle Hip Implant Product Liability Litigation, MDL No. 2244)
The first federal trial of a Pinnacle hip replacement claim is currently underway in the Northern District of Texas. Court records indicate that the case was filed on behalf of a 58-year-old Montana woman who underwent revision surgery within two years of receiving her Pinnacle hip. The lawsuit alleges that the all-metal design of the device caused the Plaintiff to suffer a range of serious complications, including cobalt blood serum levels 85 times higher than normal. (Herlihy-Paoli v. DePuy Orthopaedics Inc., 11-cv-3590)
Johnson & Johnson and DePuy Orthopaedics announced in May 2013 that they would end sales of the all-metal Pinnacle, as well as other metal-on-metal hip replacements. While the companies maintained that the decision was not driven by safety concerns, the announcement did follow an alert issued by the U.S. Food & Drug Administration (FDA) in January of that year that warned metal-on-metal hips were more likely to fail early than those made of other materials. **
Individuals who were allegedly harmed by the metal-on-metal Pinnacle hip may be entitled to pursue their own legal claim against DePuy Orthopaedics.
