Nearly four years after it was established, new DePuy Pinnacle hip lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) continue to be filed in the federal multidistrict litigation currently underway in the U.S. District Court, Northern District of Texas, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. According to an updated Master Case List issued by the Court on March 31st, 7,435 claims are now pending in the proceeding. DePuy Pinnacle Hip Litigation
According to court documents, the DePuy Pinnacle hip litigation was established in May 2011 to allow all federally-filed product liability claims involving a metal-on-metal version of the hip system that utilizes the Ultamet liner to undergo coordinated pretrial proceedings. All of the lawsuits filed in the Northern District of Texas allege that individuals fitted with this configuration are at risk for metallosis, chronic pain, premature device failure and other serious complications as a result of dangerous amounts of toxic debris shed from the hip’s metal components. They further assert that the all-metal Pinnacle did not undergo adequate testing to ensure it safety and efficacy, and thatdoctors and patients were not properly warned about its risks.
Court records indicate that the proceeding has already conducted its first bellwether trial, which concluded in October 2014 in favor of the Defense. (Case No. 11-cv-3590) The Court is currently in the process of selecting a DePuy Pinnacle lawsuit for the proceeding’s second trial.
