The number of DePuy Pinnacle hip replacement lawsuits pending in the federal multidistrict litigation currently underway in U.S. District Court, Northern District of Texas, is nearing 4,000, Bernstein Liebhard LLP reports. According to the most recent Master Case List filed with the Court, 3,983 DePuy hip replacement lawsuits had been filed in the litigation as of March 31, 2013. Bernstein Liebhard LLP is actively filing claims in the federal DePuy Pinnacle litigation. Firm partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committee for the proceeding. “We are not at all surprised that the number of DePuy Pinnacle hip replacement lawsuit filings has grown to nearly 4,000. Our firm continues to receive inquiries from all-metal Pinnacle hip recipients who have allegedly suffered early failure of their implant, metallosis and other complications,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The firm’s DePuy hip replacement lawyers continue to offer free legal evaluations to individuals who suffered serious injuries allegedly due to the metal-on-metal version of the DePuy Pinnacle Hip Replacement System.

DePuy Pinnacle Hip Replacement Lawsuits

DePuy Pinnacle hip replacement lawsuits involve an all-metal version of the hip implant system that utilizes the Ultamet liner. Plaintiffs allege the metal-on-metal hip is prone to wear and can shed dangerous amounts of metal debris, leading to serious DePuy Pinnacle complications including premature implant failure, metallosis and other debilitating complications. Court records indicate that the first trials in the federal DePuy Pinnacle litigation will begin in September 2014.

The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hips like the all-metal Pinnacle, in which the ball and cup are made from a chromium-cobalt alloy. In January, the agency proposed an order that would make these devices ineligible for 510(K) clearance, which allowed such implants to come to market with no human testing. The FDA has also recommended that doctors consider metal ion testing for all-metal hip replacement patients who are experiencing symptoms of a failing implant, including pain, swelling, loosening of the implant, or change in the ability to walk.*

The DePuy Pinnacle is just one of several metal-on-metal hip implants that have become the subject of lawsuits. Bernstein Liebhard LLP is actively filing claims in the multidistrict litigation now underway U.S. District Court, Northern District of Ohio for lawsuits stemming from the August 2010 DePuy ASR hip recall. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197) In addition, the firm is representing clients in the Biomet hip replacement litigation underway in U.S. District Court, Northern District of Indiana (In re: Biomet M2a Magnum Hip Implant Products Liability Litigation – MDL No. 2391), and is filing claims in a multicounty litigation recently established in New Jersey Superior Court for lawsuits involving the Stryker Rejuvenate hip recall. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296) Free case evaluations are also being offered to individuals affected by the June 2012 Smith & Nephew metal liner recall, as well as those who have experienced problems allegedly due to Wright Profemur and Conserve metal hip implants.

Individuals who have endured hip implant failures, metallosis, pain, or revision surgery allegedly due to the all-metal DePuy Pinnacle hip may be entitled to compensation for their medical care, pain and suffering, and other damages.
