DePuy Hip Recall Lawsuits
Court records indicate that more than 3,000 DePuy Pinnacle hip replacement lawsuits have been filed in the federal litigation underway in Texas. While no recall has been issued for the metal-on-metal Pinnacle device, Johnson & Johnson and its DePuy Orthopaedics unit did announce a recall for the metal-on-metal ASR hip implant in August 2010, after those devices were found to have an unacceptably high failure rate.* Plaintiffs in DePuy Pinnacle lawsuits allege the metal-on-metal version suffers from similar defects that cause it to shed dangerous levels of metal ions, leading to early implant failure and other complications. According to court documents, discovery in the federal Pinnacle litigation will continue through December 2013, with the first trials scheduled to begin in September 2014.
In addition to the firm’s work with DePuy Pinnacle hip replacement lawsuits, Bernstein Liebhard LLP is representing individuals impacted by the DePuy ASR recall in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio. The devices involved in both of these litigations are metal-on-metal hip implants in which the ball and cup are made from a chromium-cobalt alloy. On January 17, 2013, the U.S. Food & Drug Administration (FDA) issued new guidance for patients with such devices, advising doctors to consider metal ion testing if patients are experiencing symptoms of hip implant failure. According to the agency, metal debris released as a result of friction between the ball and cup may cause damage to bone and/or soft tissue surrounding the implant and joint. Some of the metal ions released will enter the bloodstream and travel to other parts of the body, where they may cause symptoms or illnesses elsewhere in the body.**
Victims allegedly injured by the DePuy Pinnacle and other metal-on- metal hip implants may be entitled to compensation for their medical bills, lost wages, pain and suffering, and other damages.
