We are not at all surprised that the number of Ethicon mesh lawsuits filed in New Jersey is nearing 2,700.

Vaginal mesh lawsuits involving Ethicon Inc.’s Gynecare pelvic mesh products continue to mount in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. According to an updated Case List posted on the Court’s website on May 4th, 2,682 Ethicon mesh lawsuits have now been filed in the proceeding. Bernstein Liebhard LLP is representing numerous women in the New Jersey Ethicon litigation, where Firm partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel. Vaginal Mesh Lawsuits
The litigation surrounding vaginal mesh products used to treat pelvic organ prolapse and stress urinary incontinence has been growing since July 2011, when the U.S. Food and Drug Administration (FDA) issued a public health alert stating there had been a five-fold increase in transvaginal mesh problems reported to the agency. In the warning, the FDA also re-classified the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair as “not rare,” which was a change from the position it had taken previously. According to the agency, the most common complaints associated with transvaginal mesh include mesh erosion through vaginal tissue, infection, pain, and urinary problems.*

In March, the nation’s first trial involving an Ethicon mesh lawsuit concluded in the New Jersey litigation, with the jury awarding more than $11 million to the Plaintiff, including $7.76 million in punitive damages. According to an Order issued on April 25th, the first of the litigation’s bellwether trials will begin on September 23, 2013, and will involve a vaginal mesh device used to treat pelvic organ prolapse. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”).
