We are not surprised that the number of claims pending in the consolidated litigation underway in New Jersey has now surpassed 2,800.

The number of Ethicon mesh lawsuits involving the Johnson & Johnson subsidiary’s brand of Gynecare pelvic mesh implants continues to grow in a consolidated litigation established in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. According to a Case List posted on the Court’s website on May 28th, 2,831 surgical mesh lawsuits have now been filed in the litigation by women alleging mesh erosion, infection and other injuries stemming from Ethicon mesh devices. Bernstein Liebhard LLP has filed several lawsuits in this proceeding on behalf of women who claim the implants marketed by Ethicon were defectively designed, and that the company failed to warn consumers of their serious risks for injury. Firm partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel for this litigation. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10).*

“We continue to hear from women on a regular basis who have allegedly suffered injuries stemming from Ethicon mesh products. That said, we are not surprised that the number of claims pending in the consolidated litigation underway in New Jersey has now surpassed 2,800,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices.

Surgical Mesh Lawsuits
Vaginal mesh products have been the subject of mounting concern since October 2008, when the U.S. Food and Drug Administration (FDA) alerted the public that it had received more than 1,000 adverse event reports associated with the implants over a period of three years. A little less than three years later, the FDA re-classified the frequency of complications to occur in women implanted with vaginal mesh as “not rare” after receiving an estimated 2,800 complaint reports since the 2008 safety communication. According to the agency, some of the most common side effects associated with transvaginal mesh devices, which are used to treat pelvic organ prolapse and stress urinary incontinence in women, include mesh erosion through the vaginal epithelium, pain, urinary problems and infection.**

In March, the plaintiff in the first Ethicon mesh lawsuit to head to trial in the U.S. won more than $11 million, including $7.76 million in punitive damages, after a jury in New Jersey Superior Court found that the manufacturer failed to warn of the side effects that may stem from its products. Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, served on the trial team for this surgical mesh lawsuit. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey)

Mr. Grand is also serving as Co-Liaison Counsel for a consolidated litigation underway in Atlantic County Superior Court for lawsuits involving pelvic mesh manufactured by C.R. Bard Inc. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10), and is a member of the Plaintiffs’ Steering Committees in four federal transvaginal mesh multi-district litigations underway in U.S. District Court, Southern District of West Virginia. These proceedings include: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”).

Women allegedly injured as a result of being implanted with transvaginal mesh may be eligible to seek compensation for medical expenses, pain and suffering and other damages.
