Distracted driving, including texting while driving or any use of a cell phone behind the wheel, is a crucial traffic safety issue.

Florida injury attorney Philip DeBerard, III, said today that the close of National Distracted Driving Awareness Month is a good time to restate the need for legislation and enforcement that reduces the threat posed by distracted driving.

“We stand with National Safety Council and their declaration that it’s time to change society’s acceptance of using a cell phone while driving,” said DeBerard, of the Florida personal injury firm of Philip DeBerard, Injury Attorney.

“Distracted driving, including texting while driving or any use of a cell phone behind the wheel, is a crucial traffic safety issue,” DeBerard said. “We want to ensure that awareness of this issue extends beyond a month dedicated to it. We believe a distracted driving law in Florida is one necessary part of the solution.”

Florida has no law addressing texting or cell phone use while driving. A 2012 Senate bill that would have prohibited text messaging while driving but would have allowed use of wireless communication devices while stopped at a red light died in committee.

The National Safety Council, which promotes April as Distracted Driving Awareness Month, says thousands of fatal car accidents each year involve drivers using cell phones.

“It’s time to start changing the social acceptance of cell phone use while driving,” Janet Froetscher, president and CEO of the National Safety Council, said in a released statement.

“While many understand the dangers, they still use their cell phones when they drive. We hope people will … help prevent needless tragedies and keep our roadways safer,” she said.

The law firm of Philip DeBerard, Injury Attorney, handles personal injury and wrongful death lawsuits on behalf of individuals throughout South Florida and the Treasure Coast who have been seriously injured in motor vehicle wrecks.

The firm is a longtime advocate of distracted-driving awareness. It maintains an active “Hang Up and Drive” Facebook page dedicated to informing people across Florida about the dangers of driving while texting or talking on a cell phone as well as the legal rights and options available to victims of distracted drivers.

“We will continue to push for safer roads and stand up for the rights of people injured in car wrecks caused by those who insist on engaging in distracted driving activities,” DeBerard said.

DeBerard, who has three decades of experience helping Florida families and individuals overcome serious accidents and injuries caused by others’ negligence, said those injured in automobile accidents have a right to compensation for their losses.

“Motor vehicle collisions can cause severe and long-lasting harm that includes physical, emotional and financial suffering,” he said. “Those who cause this kind of injury should be held accountable, and those who are hurt deserve assistance.”
