Specifically, the lawsuit that was filed in response to this incident was filed in the Circuit Court of the 11th Judicial District in and for Miami-Dade County, Florida. The case was assigned to the General Jurisdiction Division and it was provided with a case number of 06-7880 CA 30. The lawsuit, involving a plaintiff who was an individual female and corporate defendants, was filed in an effort to recapture damages that occurred allegedly because of the negligence of the parties named in the claim.
According to the court documents, the plaintiff was lawfully on the premises of the defendants while shopping at a mall that is located in Miami-Dade County. As she was doing so, she unknowingly encountered a foreign substance that had gathered on the floor of the property. She slipped on this substance and she fell, badly injuring her back and her neck. The court documents went on to state that the plaintiff needed extensive medical treatment that included spinal surgery and ongoing rehabilitation in order to recover as much as possible.
The plaintiff along with the Florida injury attorneys at Bernstein & Maryanoff filed the lawsuit and alleged that: (1) the defendants were legally responsible for the property where the plaintiff was injured at the time the incident occurred; (2) there was a dangerous condition present; (3) the defendants either knew or should have known about this dangerous condition; (4) the defendants did not remove this dangerous condition nor did they properly warn others of its presence; and (5) the defendants were liable for the damages incurred by the plaintiff.
Rather than fully litigate the matter, the two sides to this lawsuit were able to successfully come together and negotiate an out-of-court settlement. The specific terms of this settlement are not being disclosed per an agreement that exists between the parties. In consideration for this settlement amount, the plaintiff dismissed the lawsuit and the matter is now considered closed.
