NECC is right to anticipate a large litigation, in light of the fact that the number of fungal infections tied to its epidural steroid injections have already surpassed 400.

The New England Compounding Center (NECC), the compounding pharmacy at the center of a multistate outbreak of fungal infections, is supporting the establishment of a multidistrict litigation for all federally-filed meningitis lawsuits pending against the company, Bernstein Liebhard LLP reports. In a November 7th brief submitted to the Judicial Panel on Multidistrict Litigation (JPML), NECC asserted that the cases would be more efficiently handled before a single federal judge in Massachusetts. According to the brief, NECC is currently named in 28 meningitis lawsuits, and expects additional personal injury and wrongful death claims to be filed against it in the future.

In October, plaintiffs in fungal meningitis lawsuits petitioned the JPML for establishment of the multidistrict litigation in Minnesota federal court. [In Re: New England Compounding Pharmacy, Inc. Products Liability Litigation, MDL No. 2419 (JPML).]

“NECC is right to anticipate a large litigation, in light of the fact that the number of fungal infections tied to its epidural steroid injections have already surpassed 400,” says Bernstein Liebhard LLP, a nationwide law firm that represents people injured by defective drugs and medical devices. The firm is currently offering free fungal meningitis lawsuit evaluations to anyone affected by this outbreak and the NECC epidural steroid recall.

Epidural Steroid Recall
In September, Massachusetts-based NECC announced an epidural steroid recall for 17,000 vials of preservative-free methylprednilosone injections. In October, the company voluntarily surrendered its license and recalled all of its products. According to the latest update from the U.S. Centers for Disease Control (CDC), 438 people in 19 states who received NECC steroids have suffered fungal infections. The count includes 428 cases of fungal meningitis, 32 of which were fatal, in people who received epidural steroid injections to treat back pain. Ten peripheral joint infections were reported in patients who received steroid injections in their hips, knees, shoulders and other joints.* The New York Times reported earlier this week that some meningitis victims have also developed second infections called epidural abscesses, despite being treated with potent antifungal medications.**

Victims of the fungal meningitis outbreak linked to NECC’s epidural steroid injections may be entitled to compensation for medical expenses, lost wages, pain and suffering, and more.
