Jordan L. According to the Complaint, the siding manufactured and sold by Gentek is defectively designed and manufactured in such a way that it will prematurely fail, causing damage to consumer homes.

The national law firm of Parker Waichman LLP is pleased to announce that Jordan L. Chaikin, a partner with the firm, has been appointed to the Executive Committee for Eliason, et al. v. Gentek Building Products, Inc., et al., Case No. 1:10-cv-02093 (N.D. of Ohio, Eastern Division). The appointment was made on October 10th in the U.S. District Court for the Northern District of Ohio, Eastern Division.

The lawsuit has been filed on behalf of a number of Plaintiffs who allege that the exterior siding manufactured by Gentek is defective and fails within the warranty period. Allegedly, the manufacturer’s warranty is supposed to cover cracking, chipping, flaking, peeling or splitting for the life of the purchaser. The warranty is in effect for 50 years from the original installation in the case that the property is sold to a new owner.

According to the lawsuit, the siding peels, cracks and chips within the warranty period. Furthermore, the suit alleges that Gentek fails to honor their warranty. The Plaintiffs claim that instead of repairing, replacing or refinishing the siding as promised, the Defendants only offer a small amount of money as compensation or offer to repaint the affected area only. The suit claims that the sum of money offered is inadequate to reverse the damage, and repainting only the affected area will only lead to future repairs because it does not address the underlying problem.
