GranuFlo lawsuits (http://www.thegranuflolawsuit.com/) alleging injury and death due to the administration of GranuFlo or NaturaLyte dialysis concentrates continue to mount in courts around the country, Bernstein Liebhard LLP reports. According to court documents, the daughter of one such patient filed a wrongful death lawsuit in U.S. District Court, Southern District of Alabama on January 31, 2014, that claims her mother’s death from severe adverse cardiac events was the result of GranuFlo. “This GranuFlo lawsuit puts forth allegations similar to those contained in hundreds of other claims pending in courts around the country. The complaint also echoes what we have heard from many of our own clients who were allegedly injured by GranuFlo or NaturaLyte,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. GranuFlo and NaturaLyte are both dialysis concentrates manufactured by Fresenius Medical Care. The products are used during dialysis treatments to remove toxins from the blood in patients suffering from kidney failure. Both were recalled in June 2012, following the release of an Urgent Product Notification by Fresenius which detailed dosing issues that could result in the onset of potentially deadly cardiovascular events. The U.S. Food & Drug Administration (FDA) designated the notification a Class I GranuFlo recall, its most serious type of recall.
According to court documents, more than 500 GranuFlo lawsuits have been filed in courts around the country since the announcement of the GranuFlo and NaturaLyte recall. The majority of these claims have been filed in a multidistrict litigation now underway in U.S. District Court, District of Massachusetts (In re Fresenius GranuFlo/Naturalyte Dialysate Litigation, MDL No. 2428) Additional lawsuits have been consolidated at the state level in Massachusetts’ Middlesex County Superior Court. (In re Consolidated Fresenius Cases, No. MICV2013-03400-O).
All of the GranuFlo lawsuits pending in these litigations accuse Fresenius of failing to provide adequate warnings regarding the potential for GranuFlo and NaturaLyte to cause deadly heart side effects. According to court documents, the claims point out that in November 2011, Fresenius Medical Care issued a memo to its own dialysis clinics regarding the risks associated with GranuFlo and NaturaLyte. However, nothing was done at that time to notify thousands of dialysis centers outside the Fresenius network about the potential dangers associated with the products.
