The case was filed in an effort by the plaintiff to recover damages that were incurred as a result of the crash that led to the claim, and the plaintiff was seeking damages due to having incurred several different forms of financial and non-financial losses.
According to the court documents related to the lawsuit, the plaintiff was in her vehicle inside the boundaries of Clark County, Nevada when she was approaching a situation whereby the defendant was required to provide her with the right-of-way. The court documents allege that the defendant failed to provide the right-of-way to the plaintiff and that their vehicles collided as a result. The plaintiff was seriously injured in the crash and suffered injuries to her neck and to her hands. These injuries required extensive medical care and ongoing rehabilitation.
The court documents specifically stated that: (1) the defendant owed a legal duty of care to the plaintiff; (2) the defendant breached that duty of care by failing to yield the right-of-way to the plaintiff; (3) this failure to yield the right-of-way is what caused the accident and the injuries suffered by the plaintiff; and (4) the plaintiff suffered several forms of loss as a result of the crash.
Rather than fully litigate the matter, the Las Vegas injury attorneys at Bernstein & Poisson were able to successfully negotiate an out-of-court settlement that provided the plaintiff with a monetary sum. The specific terms of the settlement were not disclosed, as the parties executed a confidentiality agreement that governs this situation.
