The Las Vegas personal injury lawyers at Bernstein & Poisson, a law firm dedicated to providing legal representation to clients who have been injured because of the negligence, recklessness and intentional actions of others, hereby announces that the firm has filed a Nevada personal injury lawsuit against Walgreen Co., d.b.a. Walgreen’s. The lawsuit alleges that a client of the firm slipped, fell and was seriously injured on the premises of the defendant.

Specifically, the lawsuit was filed on July 17, 2012, and it was filed in the District Court of Clark County, Nevada. The case was assigned a number of A-12-665080-C, and it was given a title of Dodd v. Walgreen Co. The case was assigned to Department Number 32 and the court documents that have been entered at this point detail the basis of this legal claim.

The court documents reveal that the plaintiff alleges that on October 19, 2010, she legally entered the premises of the defendant, located at 9300 W. Sahara Boulevard in Las Vegas. The business is open to the public as Walgreen’s. While she was inside the premises, the plaintiff allegedly slipped and fell on the floor because of the presence of a leak in the ceiling that created a dangerous condition.

The court documents further allege that the defendant should be liable for damages to be determined at trial based on four theories of liability: (1) Negligence/premises liability, (2) Negligent hiring, supervision and failure to warn, (3) vicarious liability and (4) punitive damages liability. The court documents allege that the defendant knew or should have known of this dangerous condition that was present on their premises, that the employees responsible for maintaining a safe premises failed to meet their duties, that the employer is vicariously liable based on the actions of employees and that the defendant should be subject to punitive damages because the defendant allegedly acted with willful and wanton disregard for the safety of others.
