McMaken went on to say that frequently asked estate planning questions include the basics, such as what is a will, what is a trust (or a living trust), how does a living will work, what happens in probate, what is a deferred gift and how do I make one, and what are the possible tax consequences? In the area of business planning, McMaken noted that while entrepreneurs have great ideas for starting a business, they need to take several legal planning steps to help ensure their success. How do they start, run and finance a business? What is the best form for their business: corporation, LLC or partnership? What do they do first? How do they hire people and avoid a situation where they need to fire them? What is the best way for their business to set up and account for their books?
