Lipitor lawsuits (http://www.thelipitorlawsuit.com/) continue to mount in courts around the country, as Bernstein Liebhard LLP notes the filing of a new claim in West Virginia Federal Court on behalf of a woman who allegedly developed new-onset Type 2 diabetes due to her use of the cholesterol –lowering drug. According to court documents filed on October 28th in U.S. District Court, Northern District of West Virginia, the Plaintiff began taking Lipitor in 2005 and was diagnosed with diabetes in 2009. Like other lawsuits involving Lipitor and diabetes, the complaint alleges that Pfizer, Inc. failed to provide adequate warnings regarding the risks associated with the statin medication. According to a petition filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) in October, more than 100 Lipitor lawsuits involving diabetes allegations are now pending in courts around the country. Plaintiffs are seeking the consolidation of all federally-filed Lipitor lawsuits in a multidistrict litigation, and transfer of the cases to a single judge in U.S. District Court, District of South Carolina. According to their petition, a number of Lipitor claims are already pending in the district, and are being informally handled in a coordinated manner. According to court documents, the October petition marked plaintiffs’ second request for the establishment of a multidistrict litigation for Lipitor lawsuits. Their first petition, which was filed in April, was rejected by the JPML on the grounds that there were too few filings to warrant a consolidated proceeding. However, at that time, just around a dozen Lipitor lawsuits had been filed in federal courts.
Court records filed in U.S. District Court, Southern District of Illinois also indicate that a number of similar lawsuits involving Lipitor and diabetes have also been consolidated in that jurisdiction for the purposes of discovery and other pretrial proceedings. In January 2012, a study that appeared in JAMA: Internal Medicine reported that post-menopausal women treated with drugs like Lipitor were at increased risk of developing new-onset Type 2 diabetes.* A month later, the U.S. Food & Drug Administration (FDA) ordered Pfizer, Inc. to add new warnings to the Lipitor label regarding its possible association with an increased risk of diabetes.
In May 2013, the British Medical Journal also reported an association between Lipitor and diabetes, finding that patients who took the drug had a 22 percent increased risk of new-onset diabetes.**
