The Los Angeles personal injury law firm of Banafsheh, Danesh & Javid, P.C., has secured a $950,000 settlement on behalf of a 53-year-old man who suffered career-ending back, neck and shoulder injuries in powerful rear-end collision on the I-105 freeway.

The car accident happened while the plaintiff was sitting in stalled traffic in the number four westbound lane of the 105 freeway in Lynwood, California. The plaintiff alleged that the defendant was following him at a high speed in a van owned by the defendant’s employer, the County of Los Angeles.

The defendant admitted that he saw that traffic was jammed ahead of him, but he failed to stop the van before forcefully colliding with the rear of the plaintiff’s Saturn Vue.

The impact shoved the plaintiff’s Saturn into the rear of the vehicle it was following, and that car was pushed into the next stopped vehicle.

“California law requires motorists to drive at a reasonable speed, taking traffic conditions into consideration,” says Javid, a car accident lawyer with Banafsheh, Danesh & Javid.

“We contended that the defendant breached that duty and caused grievous injuries to our client. The Traffic Collision Report said the defendant was the primary collision factor.”

Javid filed a personal injury lawsuit on behalf of the plaintiff in Los Angeles County Superior Court in July 2008. The case, Medina v. County of Los Angeles and Duckworth (Case No. TC022146), was settled before trial.

Because California law holds employers responsible for their employees’ negligent acts, the plaintiff was able to recover damages from the county.

After the car wreck, the plaintiff underwent surgeries to his lower back, neck and left shoulder in an unsuccessful attempt to relieve the pain caused by his accident injuries. He also got several epidural injections, wore a back brace and took prescription painkillers, all of which failed to restore him to his pre-accident condition.

“Our client had absolutely no disabilities whatsoever before the accident, and he was working a steady job that paid more than $4,000 a month,” says Javid, who represents catastrophic injury victims throughout Southern California.

“He has not been able to return to his old job, and because of his age, low education and inability to do manual labor, experts said he won’t be able to find other employment,” Javid says.

While the settlement funds can’t give the plaintiff his pre-accident life back, they will help him pay his medical bills, secure the future treatment he needs and make up for his lost wages, Javid says.
