Specifically, the lawsuit was filed against the midwife and the doctors in the New York County Supreme Court. The case was assigned a court number of 86244A and it sought damages in response to alleged negligence on the part of the defendants that led to the infant plaintiff suffering from permanent conditions that include mental retardation and cerebral palsy based on injuries inflicted on his brain during and immediately after birth.
According to the court documents, the plaintiff’s mother reported to a hospital in New York County to give birth to her child. The child was to be delivered by a certified midwife. While the child was being delivered, the presence of meconium and a tight umbilical cord were noted. In addition, the child had an Apgar score of 0 at both 1 minute and at 5 minutes. The court documents also stated that despite discovery efforts by the attorneys at Fitzgerald & Fitzgerald, the fetal heart monitoring tapes were never produced.
The court documents went on to state the despite these obvious and serious medical problems, the infant plaintiff was not examined by a pediatrician at the hospital until 15 minutes after his birth. The attorneys at Fitzgerald & Fitzgerald argued in the court documents that the midwife failed to recognize the signs of fetal distress. The documents further alleged that inexperienced obstetrical residents negligently performed resuscitation, causing meconium aspiration.
Rather than fully litigate the matter, the New York medical malpractice lawyers at Fitzgerald & Fitzgerald were able to successfully negotiate a settlement in the amount of $1,850,000.00 just prior to the beginning of the jury selection process for trial. As a result of this settlement, the case was dismissed and the matter is now considered closed.
