Orange County family law attorney, Matthew J. Sundly of Farzad & Mazarei vindicates a father and gets him joint legal and joint physical custody after he was deprived of seeing his four year old son for two years.

It was 50/50. There was no way we were going to back down from that

Family law attorney Matthew J. Sundly has obtained an enormous victory for fathers everywhere. “It feels great knowing that our client, a good, honest and hard working father, was vindicated,” Mr. Sundly states.

Mr. Sundly refers to a case he handled on behalf of a father who had not seen his son for two years because of the mother’s refusal to allow any visitation. The father was torn between maintaining the peace and trying to resolve issues with his ex amicably or starting a custody proceeding. After all of his efforts were shunned and the mother refused to give him any time with his son, he finally took action and hired top family law firm Farzad & Mazarei to represent him. Attorney Matthew Sundly handled the case.

“Our client’s son was four years old when he hired us. That was about a year ago. We filed the paternity case immediately and obtained visitation orders. Our goal was to reconnect the father-son relationship and step up his visitation as the case went on, moving him from non-overnight visitations to overnights and eventually get him to a 50/50 custody and visitation schedule by the end of the case,” Mr. Sundly explains.

The case was venued out of Los Angeles Superior Court, Norwalk District. The case number is confidential pursuant to California law since it is a paternity matter.

“What we set out to do, we did,” Mr. Sundly says with pride. “Even though the mother fought us in family court every step of the way, our client’s visitation with his son continued to increase. When we knew it was time to progress to 50/50 custody, we asked the court for a trial date and got one.”

Mother’s case to keep the son away from his father fell apart. “We were able to show to the court the extent of her interference and that of the maternal grandmother who mother was also using to make father’s time with his son as difficult as possible,” Mr. Sundly states. “We held the mother accountable for her actions.”

On the date of trial, mother’s lawyer offered to keep the every other weekend visitation intact but Mr. Sundly and his client refused. “It was 50/50. There was no way we were going to back down from that,” Mr. Sundly states.

Finally, mother gave up. “We believe she didn’t want to explain her conduct to the court. We had gotten to the point that we were seriously considering asking for sole custody because of her refusal to co-parent, among other things.”

So a father who had developed a bond with his son thanks to his courage and exceptional legal representation, all within a budget he could afford, obtained an equal and shared custody arrangement.

The father gave the following testimonial about his legal representation: “From the first phone call to the final court appearance, the professionalism and attention to detail of the staff were nothing short of fantastic. They kept me informed and most importantly, they got me results. I’d recommend Farzad & Mazarei to anyone going through a divorce, custody, separation and want to get the results they know can’t be had without professional help.”
