Anyone who met Isel knew she was a heart-transplant patient. She wore that label proudly, even posting it on her Facebook page.

Michael Fruhling, a medical malpractice attorney at Gersowitz, Libo & Korek, P.C., one of New York’s leading personal injury and medical malpractice firms, announced that the firm is representing the family of Isel Pineda in a medical malpractice suit against Dr. Oleg Davie. According to court documents, Davie allegedly caused the death of 51-year-old Manhattan resident after a liposuction surgery [Supreme Court of the state of New York County of New York, Index Number: 805073/13].

According to court documents, Pineda suffered from heart disease and underwent heart transplant surgery in 2004. The court documents claim that Oleg Davie performed the liposuction procedure even though all medical professionals are well-informed that heart-transplant patients, such as Pineda, should not undergo such cosmetic procedures and that Davie was fully aware of Pineda's past procedure.

The court documents state that Ms. Pineda went into cardiac arrest and died on May 10th after undergoing the procedure in Davie’s Brooklyn office. She was declared dead at Coney Island Hospital.

A New York Times article reported that Davie falsified documents, which eradicated all references to the heart transplant and the anti-rejection medications that Pineda was currently taking. According to the article, it backfired when an original version of the form was later found in Pineda’s purse, clearly depicting her 2004 heart trans-plant and a list of the medications she was taking.

“Anyone who met Isel knew she was a heart-transplant patient. She wore that label proudly, even posting it on her Facebook page,” commented medical malpractice lawyer Fruhling. "Davie's actions were clearly negligent and unfortunately cost Ms. Pineda her life."

According to the New York Times article, New York State Health Department restricted Davie’s license in 2011 because of complaints from seven other patients who accused Davie of professional negligence.

“Although filing a medical malpractice lawsuit will not bring back Isel Pineda to her family and friends, they may get some of the closure they need to properly mourn her death and the satisfaction of knowing that Dr. Davie has paid for his wrongful and negligent actions," said attorney Michael Fruhling.

In addition to the civil lawsuit, Oleg is also under criminal indictment for murder. According to the New York Times article, he pleaded not guilty to manslaughter and criminally negligent homicide charges for operating on Pineda.
