A patient may even be misdiagnosed during a routine examination or the doctor fails to diagnose a serious medical condition by failing to run the proper tests which could have alerted the physician to the medical problem. A patient with meningitis may be misdiagnosed with a common flu or a patient with a heart attack may be misdiagnosed with anxiety or digestion problems.

Anesthesia errors are another frequent occurrence with medical malpractice lawsuits involving surgical procedures. Whether the patient is having an emergency operation or a simple elective gastric bypass procedure, anesthesia mistakes made before, during, or after a surgery can result in serious and permanent brain injuries or death. “I have handled medical malpractice cases involving patients who came through the operation successfully only to encounter problems in the post-anesthesia recovery room. The anesthetists made mistakes and this negligence led to a host of additional injuries for the patients. Some patients ended up with severe brain injuries, while other patients died,” remarks Dr. Fagel. “Anesthesia errors made outside of a hospital setting are particularly worrisome as the medical facility may not have access to OR nurses, emergency physicians, or other life-saving resources as a hospital. A patient with a serious medical emergency may end up having their medical condition dramatically deteriorate while waiting for an ambulance to arrive and transport them to a hospital.”
