The FDA has received 280 adverse event reports relating to the Medtronic Infuse bone graft – three-quarters of those reports involved off-label use.

Medtronic Infuse bone graft is a bone-growth protein used off-label to treat cervical spine conditions. It is also used in lower back procedures, certain dental procedures, tibia repair and degenerative disc disease repair. Although the Medtronic Infuse bone graft was approved by the U.S. Food and Drug Administration (“FDA”) in 2002 to treat the latter conditions, it has not been approved for use during cervical spine surgeries. The FDA has received 280 adverse event reports relating to the Medtronic Infuse bone graft – three-quarters of those reports involved off-label use. When used off-label in cervical spine surgeries, it has been associated with serious side effects, including:

  •     difficulty breathing;
  •     difficulty swallowing;
  •     compression of the airway requiring hospitalization;
  •     nerve damage requiring ongoing treatment; or
  •     death within one month of the procedure.

Bernstein Liebhard LLP, a New York law firm nationally recognized for its consumer protection and mass tort practices, is currently evaluating lawsuits on behalf of individuals who may have suffered Medtronic Infuse bone graft injuries.

Medtronic Infuse Bone Graft Bone Growth Cancer Link

In addition to complications resulting from the off-label use of the protein, other injuries are emerging even where the Medtronic Infuse bone graft is used to treat non-cervical spine conditions. These injuries include:

  •     unresolved radiating leg pain;
  •     nerve damage requiring ongoing treatment;
  •     retrograde ejaculation (which can cause sterility);
  •     cancer; or
  •     uncontrolled bone growth.

It is estimated that as many as 100,000 patients a year have been treated with the Medtronic Infuse bone graft. Given the severity of these side effects, the lawyers at Bernstein Liebhard LLP are offering free and confidential case evaluations to individuals who may have experienced complications or developed cancer after receiving the Medtronic Infuse bone graft during surgery.

Those who received an Infuse bone graft during surgery and suffered side effects may be entitled to compensation for medical bills, pain and suffering, lost wages and other injuries.
