Meningitis Lawsuit Update: Number of Fungal Infections Tied to Epidural Steroid Injections Rises to 480, as FDA Seeks More Authority over Compounding Pharmacies

With meningitis lawsuits moving forward, the U.S Centers for Disease Control (CDC) says 480 cases of meningitis and other fungal infections have been reported in people who received epidural steroid injections supplied by the New England Compounding Center (NECC), Bernstein Liebhard reports. The case count includes 469 cases of fungal meningitis, 33 of which were fatal, in people who received the steroids to treat back pain. Eleven peripheral joint infections were reported in patients who received steroid injections in their hips, knees, shoulders and other joints.*

According to a report from The New York Times, the Commissioner of the U.S. Food & Drug Administration (FDA) has called on Congress to provide the agency with more authority to police compounding pharmacies like NECC. During testimony before the House Committee on Energy and Commerce on Wednesday, Dr. Margaret Hamburg asserted that conflicting court decisions and a lack of clarity in the law had limited the agency’s ability to act against compounding pharmacies that fail to meet basic safety standards. Compounding pharmacies are now regulated primarily by the states, the Times said.**

In a brief submitted to the JMPL on November 7th, NECC indicated it had been named in 28 meningitis lawsuits in various federal courts. NECC said it supports the establishment of a multidistrict litigation, but asked the Panel to consider Massachusetts federal court as the venue for the consolidated proceedings.
