Metal-on-metal hip lawsuits continue to move forward in courts throughout the country, Bernstein Liebhard LLP reports. According to court documents, jury selection in the nation’s second trial involving a DePuy ASR hip lawsuit is scheduled to start tomorrow in the Circuit Court of Cook County, Illinois, with opening statements to begin Monday, March 11th. (In Re DePuy ASR Hip Litigation, No. 10-L-10506) The case pending in Illinois is the second lawsuit stemming from the 2010 DePuy ASR hip recall to go to trial this year. Jury deliberations are continuing in a case underway in Los Angeles Superior Court. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County (Los Angeles))

Metal-on-Metal Hip Lawsuits
The DePuy ASR is a metal-on-metal hip implant in which the ball and cup are made from a chromium-cobalt alloy. The DePuy ASR hip recall was announced in August 2010, after the hips were found to be failing at an unacceptably high rate. Since then, Johnson & Johnson and its DePuy Orthopaedics unit have been named in more than 10,000 metal-on-metal hip lawsuits stemming from the recall, most of which are filed in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. In the wake of the DePuy ASR hip recall, the U.S. Food & Drug Administration (FDA) launched a safety review of metal-on-metal hip replacements. In January, the agency issued new guidance for patients with such devices, advising doctors to consider metal ion testing if patients are experiencing symptoms of hip implant failure. The FDA also said it had proposed a new rule that would make metal-on-metal hip implants ineligible for the agency’s 510(k) clearance process, which allowed such devices to come to market without human testing.**

Several manufacturers of metal hip implants are also facing litigations involving their products. Bernstein Liebhard LLP partner, Jeffrey S.
