Mirena IUD lawsuits (http://www.mirenalawsuit2014.com/) continue to move forward in the multicounty litigation currently underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Case Management Order issued on December 16th, the Court has denied without prejudice a defense request to file Motions for Summary Judgment on Statute of Limitations. Mirena IUD Litigation
The Mirena IUD is a long-acting contraceptive device that was initially approved by the U.S. Food & Drug Administration (FDA) in 2000. Since then, Mirena’s approved uses have been expanded to include the prevention of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control.*
Court documents indicate that more than 1,300 Mirena IUD lawsuits are currently pending in the New Jersey litigation. All of the complaints allege that Bayer Healthcare Pharmaceuticals failed to warn that spontaneous IUD migration may occur after Mirena has been correctly inserted into the uterus by a healthcare provider. The lawsuits further claim that this occurrence caused Plaintiffs to experience a number of serious and painful Mirena complications, including uterine perforations, scarring, adhesions, infections and organ damage. Among other thing, the lawsuits cite a Warning Letter Bayer received from the U.S. Food & Drug Administration (FDA) in 2009 that took issue with Mirena promotional materials that the agency said were misleading because they exaggerated the IUD’s benefit and downplayed its potentially serious side effects.
According to court records, more than 1,100 additional Mirena lawsuits that put forth similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
