Mirena IUD lawsuits (http://www.themirenalawsuitcenter.com/) that allege serious injury due to spontaneous migration of the birth control device continue to mount in courts around the U.S., Bernstein Liebhard LLP reports. According to court documents dated September 18th, an Iowa woman has filed a complaint that alleges migration of the IUD outside of the uterus caused the device to become lodged in her rectum. Her lawsuit, which is now pending in the U.S. District Court, Northern District of Iowa, accuses Bayer Healthcare Pharmaceuticals of failing to warn that spontaneous IUD migration may occur after Mirena has been correctly inserted into the uterus by a healthcare provider. The lawsuit further alleges that the Mirena IUD caused the Plaintiff to undergo surgical removal of the device, and resulted in profound injuries, as well as great physical pain and emotional distress. Mirena IUD Litigation
Court documents indicate that more than 2,000 Mirena lawsuits have been filed in U.S. courts on behalf of women who were allegedly harmed due to spontaneous migration of the device. This includes at least 1,075 cases that are pending in a multicounty litigation currently underway in New Jersey’s Bergen County Superior Court, where Bernstein Liebhard LLP is actively filing claims. An additional 937 complaints involving similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)

According to court records, all of these lawsuits allege that spontaneous IUD migration can lead to painful and debilitating Mirena complications, including infertility, organ damage, and uterine perforations. Among other things, plaintiffs accuse Bayer of downplaying the risk of serious injury associated with Mirena, and of overstating its purported benefits.

The Mirena IUD was approved as a long-acting birth control method by the U.S. Food & Drug Administration (FDA) in 2000. In 2009, its approved uses were expanded to include the prevention of heavy menstrual bleeding in women who wish to use an IUD as their primary method of contraception. That same year, the FDA issued a Warning Letter to Bayer after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
