Mirena IUD Lawsuits Move Forward in Federal Litigation With Issuance of Protocols for Bellwether Trial Selection, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) April 15, 2014 -- Hundreds of Mirena lawsuits (http://www.themirenalawsuitcenter.com ) continue to move forward in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York, Bernstein Liebhard LLP reports. According to an Order issued on April 9, 2014, the Court has established protocols for the selection of cases for early bellwether trials. Among other things, the Order directs counsel for the parties to select 24 cases for an Initial Deposition Pool by June 3, 2014. According to court filings, plaintiffs in these claims allege that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of spontaneous migration and related complications. Among other things, they point out that Bayer received a Warning Letter from the U.S. Food & Drug Administration (FDA) in December 2009 that faulted one of the company’s Mirena promotions for exaggerating the benefits purportedly associated with the IUD, and understating its risks. The lawsuits also point out that the Mirena label does not mention spontaneous IUD migration as a potential risk, but only warns that migration may occur if the uterus is perforated when the IUD is initially inserted in the uterus. All of the plaintiffs in these claims allege that their IUD was correctly inserted by their doctor.
