More than 900 Mirena IUD lawsuits (http://www.drugbot.com/mirena-iud/lawsuit/) filed on behalf of women who were allegedly injured due to spontaneous device migration continue to move forward in a multicounty litigation currently underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, the proceeding’s next Case Management Conference has been scheduled for September 23, 2014 at 2:00 p.m. The parties have been directed to submit a proposed agenda to the Court seven days prior to the date of the Conference. Mirena Lawsuit Allegations
The Mirena IUD was brought to market in 2000 and is now approved as both a contraceptive and as a treatment for heavy menstrual bleeding in women who wish to use an IUD for contraception. In December 2009, the U.S. Food & Drug Administration (FDA) issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
Court documents indicate that more than 920 lawsuits have been filed in Bergen County Superior Court on behalf of women who allegedly suffered serious Mirena complications related to spontaneous migration of the device, including uterine perforations, organ damage and infertility. The lawsuits further allege that Bayer did not warn doctors or patients that the IUD could spontaneously migrate from its proper position in the uterus, even following correct implantation. According to the complaints, the labeling for the Mirena IUD merely warns that the device may migrate if the uterus is punctured during its initial insertion.
In addition to the cases pending in New Jersey, court records show that hundreds of additional Mirena IUD lawsuits involving similar allegations have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York.
